MEDIA GIVEN BRIEF CONTENTS OF RA FIRST OMBUDSPERSON'S 2005

YEREVAN, FEBRUARY 10, NOYAN TAPAN. RA first Ombudswoman
Larisa Alaverdian gave the brief contents of the 2005 report on
her activity and violations of the human rights and freedoms in
the country to a number of mass media. According to the February
6 statement of RA National Assembly Speaker Artur Baghdasarian,
not the author but the newly elected Ombudsperson will present
the report at the Parliament.
The estimations and conclusions made in the report were
reasoned with more characteristical examples of the cases.
Particularly, among them are:
- the case of Razmik Sargsian accused of murder in the army
who was in a long-term hunger strike as a complaint against the
unjust accusation and unjust and preconceived trial.
- the criminal action brought against attorney Vahe
Grigorian, the "Right Legal Service" LTD Director. The attorney
protected the Yerevan Buzand street inhabitants from the state
and judicial structures' obvious wilfulnesses on the cases of
compulsory sale of their ownership. Exhausting all means of
innerstate legal protection on two of the above-mentioned cases,
V.Grigorian formed and presented complaints of his principals to
the European Court of Human Rights.
- the case concerning compensasion of demage to No 29/1,
29/2, 29/3 households of the Hrazdan street as a consequence of
over-flows of the Hrazdan river. The Yerevan Mayor's Office, the
Minister on Territorial Government and Government
representatives were engaged in this case, not giving solution
to fatal problem of the families living in these addresses.
- the case concerning lands given with the leasehold right
to families of 28 people died or become invalid during the
Artsakh freedom-fight. The case is characterized by violation of
the order fixed by the law and by an auction just with those
schemes, the fact of usage of which the RA President affirmed,
publicly censuring for using them the Yerevan Mayor while
discussing the annual report.
- the cases on continued complaints concerning compulsory
sale of citizens' ownership connected with the building programs
of the city of Yerevan.
It's mentioned in the report, that one of reasons for cases
of violation of the human rights and fundamental freedoms is the
dependence of the judicial system, which in spite of some
constitutional reforms factually remained unchaged, as the RA
President is to make a final decision on appointing judges and
stopping judges' commissions. At the same time, the practics
that has already been formed and the "judicial power - executive
power" relations put under doubt productivity of numerous
reforms in the judicial system.
Numerous examples prove that public bodies' unscrupulous
representatives' displays of bad administrative work having a
systematic character, higher authorities' tolerance towards such
actions bring to the human rights continuous violations of the
same character and lead to deepening of those events.
According to the report, the corruption gradually becomes a
bigger and bigger factor in the "individual-state" relations,
bringing to strengthening repulsive attitude towards the law and
right among the society.
"Public servicemen's low legal consciousness, not knowing
of the sphere of human rights and the laws and famous
international norms regulating that sphere by the state, and
sometimes neglect towards them, are of system character and
directly obstacle protection of both civil and political and
social, economic and cultural rights," is mentioned in the RA
first Ombudsperson's report.
It's also mentioned in the low that "the principle of
punishability isn't used towards representatives of state bodies
making numerous violation of the human rights, and often those
violations are masked under the patronage of higher
authorities."
