NATIONAL ASSEMBLY PASSES IN THIRD READING LEGISLATIVE
PACKAGE ON PROPERTY AKIENATION FOR PUBLIC AND STATE NEEDS

YEREVAN, NOVEMBER 27, NOYAN TAPAN. At the special session
on November 27, the RA National Assembly passed 21 draft laws
and legislative packages discussed on the last day of the
previous four-day session. The legislative package on the
alienation of state property for state and public needs was
passed in full in 3rd reading with 70 votes in favor and two
abstentions. Besides the draft law of the same name, it also
includes some draft laws on making amendments to the RA Land and
Civil Codes. The representatives of the opposition factions -
Justice, National Unity and Orinats Yerkir, as well as some
independent deputies did not participate in the vote. The
Secretary of the Justice faction Grigor Harutyunian told NT
correspondent that after the RA president ratifies the law
passed by the National Assembly, the opposition will apply to
the RA Constitutional Court to dispute the law's
constitutionality.
To recap, in accordance with the passed draft law, property
is alienated for public and state needs only if the government
recognizes the purpose of the alienation as a superior public
interest. Property may be alienated in favor of the state,
community or organization. The property owner is paid a sum
exceeding 15% of the market value of the property alienated.
